Regulations of Jiangsu Province on Poverty Alleviation and Development in Rural Areas

Chapter I General Provisions
Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations, in light of the specific situation of this Province and for the purposes of promoting the work of poverty alleviation and development in rural areas,standardizing activities in poverty alleviation and development in rural areas, promoting coordinated urban-rural and regional development, and realizing common prosperity.
Article 2 These Regulations shall apply to the poverty alleviation and development in rural areas within the administrative region of this Province.
The poverty alleviation and development in rural areas as mentioned in these Regulations refer to activities carried out by the state organs and all circles of society to help the targets of poverty alleviation and development improve their self-development abilities, shake off poverty and become prosperous through measures such as offering financial support, industry support and hooked-up help and support, improving infrastructure, working, living, education, medical and health care conditions, carrying out skill trainings and promoting the employment in other sectors.
Article 3 The principles of government sponsoring, planning leading, industry support, social participation and self-reliance shall be adhered to during the work of poverty alleviation and development in rural areas and the work shall be integrated with agricultural modernization building, ecological civilization building and new-typed urbanization building.
Article 4 The local people's governments at various levels shall be responsible for the work of poverty alleviation and development in rural areas in their respective administrative regions, establishing and perfecting the coordination mechanism for poverty alleviation and development in rural areas, establishing targeted working mechanism for poverty alleviation establishing and implementing the target responsibility and assessment system for poverty alleviation and development in rural areas and taking the completion of the target of poverty alleviation and development in rural areas as an important part for the assessment of the people's governments at various levels and relevant departments and their members in charge.
Article 5 The local people's government at or above the county level shall incorporate poverty alleviation and development in rural areas into the planning for national economic and social development and formulate specific planning for poverty alleviation and development in rural areas. Where other specific development planning formulated by the local people’s government at or above the county level involve poverty alleviation and development in rural areas, they shall be compatible with the specific planning for poverty alleviation and development in rural areas and give priority to meeting the demands of areas of poverty alleviation and development in rural areas.
Article 6 The local people's government at or above the county level shall specify the institution responsible for poverty alleviation and development in rural areas and for the specific work for organization coordination, promotion, supervision and administration of poverty alleviation and development in rural areas in their respective administrative regions.
The people’s government at the town level and the sub-district office shall specify the staff members responsible for poverty alleviation and development in rural areas.
Article 7 The local people's governments at various levels shall organize and carry out dissemination on poverty alleviation and guide all circles of society to participate in poverty alleviation and development in rural areas.
The people's government or relevant departments shall commend the units and individuals that have made outstanding contributions to poverty alleviation and development in rural areas.
Chapter II Targets of Poverty Alleviation and Development in Rural Areas
Article 8 The targets of poverty alleviation and development in rural areas include economically underdeveloped villages and low-income farming households. The low-income farming households with disabled persons or with other special difficulties shall be given priority to getting support.
The economically underdeveloped village refers to the administrative village whose collective economic income and annual per capita net income of farmers are comparatively low and where the number of low-income farming households is comparatively large.
The low-income farming household refers to the farming household whose annual per capita net income is lower than the certified standard of poverty alleviation and the farming household that has working ability, including the targets of rural minimum life guarantee who have working ability.
The certification standards for economically underdeveloped village and low-income farming households are formulated by the provincial people's government and the people's government of the city divided into districts and at the county level may formulate the certification standard higher than the provincial standard. The government at the county level shall certify economically underdeveloped villages and low-income farming households in accordance with the certification standards.
Article 9 The low-income farming households shall be certified in accordance with the following procedures:
(1) the villagers’ (neighborhood) committee shall publicize the announcement of application for low-income farming households in their respective villages (residential areas);
(2) the farming households shall submit application to the villagers’ (neighborhood) committee;
(3) the villagers’ (neighborhood) committee shall hold the villagers' (neighborhood) meeting or the villager (neighborhood) representatives’ meeting to carry out appraisal and publicize the appraisal results after the villagers’ (neighborhood) committee has conducted the preliminary examination on the application of the farming households;
(4) the people's government at the town and township level and the sub-district office shall examine the appraisal results and publicize the examination results; and
(5) the people's government at the county level shall certify the examination results and the villagers’ (neighborhood) committee shall publicize the certified name list.
The villager that has any objection to the examination results may file an application to the people's government at the town and township level and the sub-district office for a review within 30 days after the examination results are publicized, and the people's government at the town and township level and the sub-district office shall conduct investigations and verifications and publicize the review result within 10 working days.
Article 10 The local people's governments at or above the county level shall establish information archives for and implement dynamic administration of the certified targets of poverty alleviation and development in rural areas.
Where a low-income farming household reaches the standard of shaking off poverty after getting help and support, the villagers’ (neighborhood) committee shall report it to the people's government at the town and township level and the sub-district office for examination and the people's government at the town and township level and the sub-district office shall report it to the people's government at the county level for certification. The villagers’ (neighborhood) committee shall publicize the low-income farming households that are certified to have shaken out poverty in the village (residential area) where they live.
Article 11 The local people's governments at or above the county level shall make the policy of poverty alleviation and development in rural areas effectively compatible with the system of minimum subsistence guarantee in rural areas. The specific measures shall be prescribed separately by the Provincial People’s government.
Chapter III Measures of Poverty Alleviation and Development in Rural Areas
Article 12 The local people's government at or above the county level shall promote poverty alleviation by special projects, industries and the society through overall planning, adopt measures aimed at poverty alleviation and development and comprehensively improve the capability of poverty alleviation and development in rural areas in accordance with the specific situations of the targets of poverty alleviation and development in rural areas and in accordance with the requirements of targeted poverty alleviation.
The working institution of poverty alleviation and development in rural areas shall inform low-income farming households of various preferential policies of poverty alleviation and development in rural areas and helping and supporting measures which cover all villages and households in the forms such as contacting cards and bulletins。
Article 13 The local people's government at or above the county level may take the area where low-income farming households are relatively concentrated and the number of economically underdeveloped villages is comparatively large as the key area of poverty alleviation and development, provide help and support to the key area and carry out development in connected land with various agriculture related funds and social helping and supporting resources through overall planning.
Article 14 The people's government of this Province and the city divided into districts shall establish and perfect the mechanism of hooked-up help and support. The State organs, people’s organizations, institutions, state-owned enterprises, science and research institutes and institutions of higher education shall provide hooked-up help and support for the targets of poverty alleviation and development in rural areas and the economically developed areas shall provide hooked-up help and support for rural areas of poverty alleviation and development.
Article 15 The local people's government at or above the county level shall establish the system of helping and supporting team, assist grassroots organizations to implement policies of poverty alleviation and development in rural areas, participate in the work of poverty alleviation and development in rural areas and help economically underdeveloped villages and low-income farming households shake off poverty and become prosperous.
Article 16 Departments and units of development and reform, economy and informatization, communications and transportation, housing and urban and rural construction, land resources, water resources, radio, film and television, electric power and communications shall, in accordance with their respective functions and duties, incorporate the improvement of development environment and conditions of the rural areas of poverty alleviation and development into relevant special planning, give priority to the infrastructure construction such as roads, farm land irrigation, drinking water safety, renovation of dilapidated buildings, electric power and telecommunication in rural areas of poverty alleviation and development, and improve the working and living conditions of the rural areas of poverty alleviation and development.
Article 17 The department of agriculture shall put into full play the advantages of the rural areas of poverty alleviation and development in natural resources, promote advanced practical technologies, cultivate and strengthen the characteristic pillar industry, lead and help the targets of poverty alleviation and development in rural areas develop their production through supporting business entities such as leading enterprises, specialized farmers cooperatives and family farms.
Article 18 The department of education shall strengthen the basic education and vocational education in the rural areas of poverty alleviation and development, formulate and perfect the education subsidy system and improve the basic cultural quality of the local people and the technology and skill of the workers.
The department of human resources and social security shall strengthen the professional skill training and the employment and business startup guidance and service for labors from low-income farming households in the rural areas of poverty alleviation and development and promote the employment in other sectors.
The department of health and family planning shall strengthen the building of medical and health institutions and teams in the rural areas of poverty alleviation and development, improve the facilities and conditions of medical treatment and rehabilitation, organize and carry out helping and supporting activities such as diagnosis and treatment services and technical training, and improve the technical level and service capability of medical treatment in the rural areas of poverty alleviation and development.
The department of science and technology shall establish and perfect the new-typed science and technology service system in compliance with the specific situations of the rural areas of poverty alleviation and development, select and send special technical commissioners to provide help and support in science and technology, strengthen science and technology services in the rural areas of poverty alleviation and development and promote transformation of scientific or technological achievements.
Other departments of civil affairs, culture and tourism shall, in accordance with their respective functions and duties, carry out poverty alleviation and development work in different trades through measures such as carrying out relief work, developing cultural undertakings and promoting the development of tourism.
Article 19 The local people's government at or above the county level encourages financial institutions to provide small loans for poverty alleviation to low-income farming households through offering subsidies for loan interests and risk compensations.
The financial institutions are encouraged through measures such as policies and subsidies to support the development of the rural areas of poverty alleviation and development, to innovate in the financial product and service methods in rural areas and to satisfy the diversified demands of financial services in rural areas.
The insurance institutions are encouraged through measures such as policies and subsidies to establish grassroots service stations in the rural areas of poverty alleviation and development, perfect the policy on subsidies to agriculture insurance premium, and develop characteristic agriculture insurance.
Article 20 The local people's government at or above the county level shall establish the system to mobilize social powers to participate in poverty alleviation and development in rural areas, formulate encouraging measures and establish the social platform for communicating and sharing poverty alleviation information.
The enterprises, social organizations and individuals are encouraged to participate in poverty alleviation and development in rural areas by the ways such as setting up enterprises, carrying out cooperative development, building production bases, providing employment opportunities and making charitable donations.
The enterprises, social organizations and individuals that participate in poverty alleviation and development in rural areas are entitled totaxation preferences according to law.
It is advocated to carry out volunteer activities for poverty alleviation and establish the network of volunteer service for poverty alleviation.
Chapter IV Funds and Projects for Poverty Alleviation and Development in Rural Areas
Article 21 The funds for poverty alleviation and development in rural areas mainly include:
(1) the funds for poverty alleviation arranged by the Ministry of Finance and local government;
(2) the funds for poverty alleviation raised bythe State organs;
(3) the funds donated by the social organizations and individuals; and
(4) other funds used for poverty alleviation and development in rural areas.
Article 22 The local people's government at or above the county level shall establish the mechanism to guarantee the financial investment in poverty alleviation which is compatible with the economic development level and poverty alleviation task of the corresponding area.
The special financial funds for poverty alleviation shall be used for providing direct help and support to the targets of poverty alleviation and development in rural areas and improving the development capability and the working and living conditions of the targets of poverty alleviation and development in rural areas.
Article 23 The local people's government at or above the county level shall establish the administration mechanism of the funds for poverty alleviation and development in rural areas, implement unified administration and use the funds for the designated purposes. No unit or individual shall intercept, misappropriate or usurp the funds.
Article 24 The department of finance and the working institution of poverty alleviation and development in rural areas shall, together with other relevant departments, conduct performance examination and evaluation on the use and administration of the special financial funds for poverty alleviation.
The department of audit shall audit and supervise the use and administration of the special financial funds for poverty alleviation according to law.
Article 25 The local people's government at or above the county level shall, in accordance with the special planning for poverty alleviation and development in rural areas, conduct scientific verification, adapt poverty alleviation to local conditions, certify and carry out projects of poverty alleviation and development in rural areas.
The projects of poverty alleviation and development in rural areas shall exercise project administration systems such as the project responsibility system and the contract administration system.
Where the project of poverty alleviation and development in rural areas uses the financial funds, the use of the funds shall be assessed by the third party.
Article 26 The people's government at the county level shall establish the system for administration and protection of the assets of the projects of poverty alleviation and development in rural areas, and specify the subjects and responsibilities of administration and protection in accordance with the principle that whoever benefits from the assets shall be responsible for administration and protection.
No unit or individual shall occupy, sell or damage facilities, equipment and other assets formed by the projects of poverty alleviation and development in rural areas without authorization.
Chapter V Legal Liabilities
Article 27 Where the working institution of poverty alleviation and development in rural areas, relevant departments or their staff members abuse their powers, neglect their duties or commit malpractice for individual gains, the person directly in charge and other persons directly responsible shall be given sanctions according to law; where a crime is constituted, the criminal liabilities shall be investigated in accordance with law.
Article 28 Where anyone, in violation of the provisions in Article 23 of these Regulations, intercepts, misappropriates or usurps the fund for poverty alleviation and development in rural areas, the relevant department shall order him/her to make correction within a prescribed period of time and give him/her a sanction or penalty according to law; where a crime is constituted, the criminal liabilities shall be investigated in accordance with law.
Article 29 Where anyone, in violation of the provisions in the second paragraph of Article 26 of these Regulations, occupies, sells or damages facilities, equipments and other assets formed by the projects of poverty alleviation and development in rural areas without authorization, the relevant department shall order him/her to make correction within a prescribed period of time and give him /her a sanction or penalty according to law; where a crime is constituted, the criminal liabilities shall be investigated in accordance with law.
Article 30 Where anyone defrauds preferential policies, money or materials for poverty alleviation and development in rural areas by making false reports, concealing, falsifying and other ways, the relevant department shall criticize and educate him, revoke his preferential treatment, order him/her to return the money or materials and confiscate his/her illegal gains; where a crime is constituted, the criminal liabilities shall be investigated in accordance with law.
Article 31 Any unit or individual is entitled to report and lodge a complaint against any act in violation of these Regulations to the working institutions of poverty alleviation and development in rural areas and relevant departments.
Chapter VI Supplementary Provision
Article 32 These Regulations shall enter into effect as of May 1, 2015.
